In-vitro diagnostic reagents sit inside the Philippine medical-device framework, but they are classified by their own rules, judged on their own kind of evidence, and stopped at the border for their own reasons — usually cold chain. What “IVD Certification in the Philippines” Actually Means

There is no certificate called “IVD certification” in the Philippines. What lets you sell an in-vitro diagnostic here is two Philippine FDA authorizations stacked on each other — a company-level License to Operate (LTO) and a per-product authorization, either a CMDN notification or a registration certificate, the one the trade calls the CPR. Anyone quoting you “the IVD certificate” is describing one of those two.

The confusion is worth clearing up, because buyers, tenders and freight forwarders all use the word “certification” for three different things:

  • Philippine market authorization — the LTO plus the CMDN or registration/CPR. This is the only pair that makes the product legal to import and sell here, and it is what the rest of this guide is about.
  • Manufacturer-side quality certificates — ISO 13485, a CE certificate, a US FDA clearance, a Certificate of Free Sale from the country of origin. These are supporting documents inside your Philippine file. They shorten the argument; they never replace the filing.
  • Lot- or shipment-level clearance — the consignment paperwork that releases a specific arriving batch of regulated health goods. It is issued against your standing authorization, not instead of it.

Why IVDs Are Handled Apart From General Medical Devices

An in-vitro diagnostic never touches the patient. It acts on a specimen taken out of the body — serum, plasma, whole blood, urine, stool, swabs, tissue — and gives back information. That one fact reshapes the entire regulatory conversation, which is why treating in-vitro diagnostic reagents as “just another medical device” is the first place importers lose months.

  • The harm is informational, not mechanical. An IVD does not perforate, corrode or fail structurally. It produces a wrong number or a wrong line, and the damage arrives through the clinical decision built on top of it — a missed infection, an untreated case, a wrongly dosed patient.
  • So the evidence is different. Nobody asks a reagent kit for biocompatibility or fatigue data. They ask for analytical performance, diagnostic performance, cut-offs, reference intervals and stability — none of which appear in an implant dossier.
  • The classification rules are different. IVD Classification in the Philippines: Risk Class A to D and the Route It Dictates

IVD classification in the Philippines runs on the ASEAN four-class scale — A, B, C and D — and the class is what decides whether you file a notification or a full registration. The class is not read off a product list; it is argued from the intended use.

Philippine practice mirrors the ASEAN four-class scale — A, B, C and D — but the questions that set an IVD’s class are diagnostic questions, not mechanical ones:

  • What follows a wrong result? Tests driving urgent or irreversible clinical action rank higher than tests whose result will be checked again anyway.
  • Is there a public-health dimension? Assays used to screen blood, tissue or donors for transmissible agents, or to detect highly transmissible agents, sit at the top of the scale. A false negative there is not one patient’s problem.
  • Who reads the result? A self-test intended for a layperson is treated more strictly than the same chemistry run by a trained medical technologist, because no professional judgment sits between the result and the action taken.
  • Standalone or confirmatory? A test used alone to rule a condition in or out carries more regulatory weight than one whose result is always confirmed by another method.

What typically lands in each class. These are the patterns the ASEAN rules produce, not a lookup table — the FDA decides on the intended use you state, so confirm your class against the circular in force on your filing date:

  • Class A IVD — low risk to the patient, low risk to the public. Specimen receptacles, general-purpose laboratory reagents and buffers, culture media, and instruments or analysers that carry no diagnostic claim of their own.
  • Class B — moderate risk to the patient, low risk to the public. The broad middle of routine work: clinical chemistry and hematology panels, cholesterol and glucose, urine strips, pregnancy self-tests.
  • Class C — high risk to the patient, moderate risk to the public. Assays whose result drives treatment largely on its own: tumour markers, companion diagnostics, self-tests for serious conditions, and detection of infectious agents outside donor screening.
  • Class D — high risk to the patient and to the public. Screening of blood, tissue and organ donors for transmissible agents (HIV, hepatitis B and C, HTLV, syphilis), tests for agents that are both highly transmissible and life-threatening, and the blood-group systems used to assure transfusion compatibility (ABO, Rhesus, Kell, Kidd, Duffy).

A Class A IVD is the lightest file, not an exempt one — it still sits under an LTO and still needs its notification on record before the kit can be imported or sold.

The class then decides the route. Lower-risk IVDs generally travel the notification path and end in a Certificate of Medical Device Notification (CMDN); higher-risk IVDs travel the registration path, with a fully assessed technical dossier, and end in a registration certificate — what the trade normally just calls the CPR. Notification is lighter, not laxer: the dossier still has to exist, still has to be correct, and the FDA can call it in.

Two warnings. First, the notification-versus-registration boundary moves. The FDA has been steadily migrating categories out of notification and into full registration, with transition windows. “Our kit only needed a notification last time” is a hypothesis, not a plan — confirm against the circular in force on your filing date. Second, emergency pathways are not a route to market. The special authorizations that carried pandemic-era test kits were temporary by design; a product that entered that way still needs an ordinary filing to stay on the market.

Import License for IVDs in Philippines: There Is No Standalone Permit

There is no separate import license for IVDs in the Philippines. The function of an import license is performed by two things together: a company-level LTO naming you as importer or distributor, and a product-level CMDN or registration for each item you bring in.

This is the most common misunderstanding in the category, and it is worth stating flatly: the Philippines does not issue a single stand-alone permit that lets you import diagnostics.   • The establishment license — the LTO (License to Operate) — issued to a company for a declared activity: importer, distributor or wholesaler, trader, or manufacturer. It licenses the company, is tied to a declared and inspectable warehouse and to a qualified technical person, and is what makes you a lawful handler of medical devices at all.
  • The product authorization — the CMDN or the registration/CPR — issued per product and held under that LTO.

Neither works alone. An LTO with no product authorization lets you import nothing. A product authorization cannot even be applied for without an LTO, because the license holder is the applicant. A foreign manufacturer has two shapes to choose between:

  • Your own Philippine entity holding its own LTO. You own the registrations, control pricing and channel, and carry the post-market duties yourself. Slower to stand up, but nothing is hostage.
  • An appointed local authorized representative that already holds a device LTO. The fastest way in, and it can run in parallel with your incorporation — but the registration sits in their name. Moving it later is a re-filing, not an edit, and if the distributor relationship sours your market access is on their side of the table. Agree transfer, termination and data-handover terms before the first filing, not after.

The Technical File: What an IVD Actually Has to Prove

An IVD dossier follows the ASEAN CSDT structure, but its substance is diagnostic. Reviewers are not reading it to admire the chemistry; they are reading it to see whether the claim printed on the box is supported by evidence rather than assertion. Expect to have to cover:

  • Intended use, stated once and stated everywhere. Target analyte or measurand; specimen types and matrices; qualitative, semi-quantitative or quantitative; screening, diagnostic, monitoring or confirmatory; intended user (professional or self-test); intended population and setting. Every later document has to repeat this wording exactly.
  • Analytical performance. Analytical sensitivity and detection limits (limit of blank, detection, quantitation); analytical specificity, meaning cross-reactivity and interference (hemolysis, lipemia, bilirubin, common medications, related organisms); precision, covering repeatability and reproducibility across runs, days, operators, lots and sites; linearity and measuring range; trueness and method comparison; carry-over; and, where the assay format allows it, high-dose hook effect.
  • Clinical or diagnostic performance. Diagnostic sensitivity and specificity, or positive and negative percent agreement, against a clearly named comparator or reference method, in a population resembling the one you claim — with study design, sample sizes, and how discordant results were resolved. A study run entirely on a distant population, submitted without discussion of applicability, invites a query.
  • Cut-offs and reference intervals. How the cut-off was established and then validated on an independent set; for quantitative assays, the reference interval or expected values and the basis for them. If you adopt an interval from the literature, say so and justify its applicability rather than presenting it as your own data.
  • Stability. Real-time shelf-life data supporting the expiry you actually print (accelerated data supports a provisional claim, it does not replace real-time); plus in-use or open-vial stability, on-board stability for analyser reagents, specimen stability, transport and shipping stability, and freeze-thaw where relevant.
  • Traceability and lot control. Metrological traceability of calibrators and controls, value assignment, lot-release criteria, and the quality-control scheme the end user is expected to run.
  • The system around the reagent. Where an analyser or software forms part of the claim: instrument description and compatibility, software version and validation, and cybersecurity where the device is networked or exports results.
  • Quality and legal support. The manufacturer’s ISO 13485 or equivalent quality-management evidence, the risk-management file, a Certificate of Free Sale or Certificate to Foreign Government from the country of origin, and a letter of authorization naming the local license holder — with model names and catalogue numbers matching your application exactly.

Two structural habits decide whether the file reads well. Name the standards you actually used — quote the specific analytical-performance, clinical-evaluation and stability protocols your studies followed, with their versions, instead of writing “in accordance with international standards”, which reviewers read as “we did not follow one”. And legalize early: foreign-issued free-sale certificates, authorization letters and QMS certificates generally need notarisation plus apostille or consular authentication, and that queue, not the technical assessment, is what usually sets your real start date.

Philippines IVD Labeling, IFU and Getting the Shipment Released

Philippines IVD labeling has to be in English and has to say the same thing your dossier says. The mandatory content is the in-vitro diagnostic use statement, intended use, kit contents, catalog and lot number, expiry, validated storage and transport temperatures, the manufacturer, and the Philippine license holder with address — plus the authorization number once granted.

After the science, two things get checked: what the box says, and whether the box arrived intact.

Labels and instructions for use. The recurring theme is consistency — label, IFU and dossier must describe the same product with the same claims. Expect to carry, in English:

  • Product name plus an explicit in-vitro diagnostic use statement, and “for professional use” or self-test wording as applicable.
  • Intended use, kit contents and quantities, catalogue number, lot number, date of manufacture and expiry date.
  • Storage and transport conditions — the temperature range you actually validated — and in-use conditions after opening or reconstitution.
  • Manufacturer name and address, and the Philippine license holder (importer or authorized representative) with address; once granted, the notification or registration number.
  • Warnings, limitations, biohazard and disposal statements, and recognised symbols with a key explaining them.

The most avoidable rejection in this whole area is a label promising something the dossier never proved: an extra specimen type, a broader claim, a longer shelf life. Finalise artwork against the dossier, not against the marketing deck.

Import release. A shipment of authorized IVDs still clears as regulated goods. The customs entry must be lodged by a party entitled to do so; the FDA license and product authorization must be referenced and must agree with the commercial invoice and packing list on product names, catalogue numbers and quantities; and shipments of regulated health products routinely require a consignment-level FDA clearance in addition to the standing product authorization. Cold chain is where IVD import differs most. Most reagents live at 2–8°C, some at −20°C or lower, and the Philippines is an unforgiving environment for that:

  • Validated packaging and monitored transport. Qualified shippers, coolant sized for the actual route and season, and a temperature logger in the box — not a certificate stating it was cold when it left the factory.
  • Dwell time is the enemy. Every day of documentary hold at the airport is a day of coolant burning down in tropical heat. Pre-lodging documents and having the entry ready before the aircraft lands matters far more here than for dry cargo.
  • Excursion handling agreed in advance. Decide before the shipment who reads the logger, what excursion the manufacturer’s stability data genuinely tolerates, and who quarantines and who releases. Without that, an excursion becomes an argument instead of a decision.
  • Remaining shelf life on arrival. Hospital groups, laboratory chains and public tenders commonly demand a minimum remaining shelf life at delivery. Short-dated stock that clears perfectly can still be commercially dead, so plan the shipping calendar against the expiry date, not just the purchase order.
  • Storage after clearance. The warehouse declared on your LTO has to hold the same conditions: monitored and mapped cold storage, alarms, backup power against brownouts, and records that survive an inspection.

Why Files Come Back, and How Time and Cost Behave

Deficiencies in IVD filings cluster, and nearly all of them are avoidable:

  • Wrong class. General-device logic applied to a diagnostic, or a screening or self-test product filed one class too low. Everything downstream is then wrong.
  • Intended-use drift. Dossier, label, IFU and free-sale certificate describe subtly different products or subtly different claims.
  • Scope mismatch. Model names, kit sizes or catalogue numbers on the authorization letter, the free-sale certificate and the application do not line up; or an analyser and its reagents are filed with an unclear relationship.
  • Performance data that does not support the claim. No comparator named, no cut-off justification, no reference interval, a study population unrelated to the claimed one, or specimen types claimed on the label but never tested.
  • Stability shorter than the printed expiry, accelerated data offered where real-time data was expected, or missing open-vial and transport stability.
  • Legalisation gaps. An expired free-sale certificate, unauthenticated foreign documents, or an authorization letter that has lapsed or names an entity other than the applicant.
  • Silent changes. A manufacturing site, formulation, kit configuration or label changed after filing and never reported. Discovered later, this is worse than a slow approval.

How long it takes is a mechanism, not a number. It is driven by the class and route (notification versus full registration), the completeness of the file on day one, whether the FDA issues a deficiency or compliance letter — answering one restarts a clock rather than continuing it — and by the legalization queue in the country of origin, which should start before anything else and is the most common hidden cause of a slow start. What it costs is likewise structural. There is no single directory — access runs through whichever company holds the License to Operate (LTO) and the product-level authorization for that kit, because the license holder is the applicant and the only lawful route to market. A foreign manufacturer becomes a provider here in one of two ways: standing up its own Philippine entity and holding its own LTO, or appointing a local authorized representative that already holds a device LTO to act as license holder while the manufacturer's own incorporation proceeds in parallel. Either way, the "provider" a hospital or laboratory ultimately buys from is whoever's name sits on that LTO and registration.
