Philippine Marriage Certificate Requirements: Who Qualifies, Which Copy Counts, and What Each Counter Actually Asks For

Requirements for a Philippine marriage certificate are not one list. They are three: whether the marriage was validly contracted, whether the record reached the PSA so a copy can be printed, and whether the office you are handing it to will accept that particular copy. Different bodies own each layer, which is why asking one question gets three contradictory answers. This page is a comparison table rather than a walkthrough: who qualifies, who may request a copy on your behalf, the five different documents people loosely call a marriage certificate, and how the requirements shift depending on whether the paper stays in the Philippines, goes to mainland China, or travels to a third country.

Three Layers of Requirements, Three Different Authorities

Separate the question before you chase a checklist. One layer asks whether you are married, one asks whether the PSA can print proof, and one asks whether a specific counter will take that proof.

Layer one: validity. This belongs to the Family Code (Executive Order No. 209). A marriage is contracted when the parties have legal capacity, consent freely in the presence of a solemnising officer authorised by law, hold a valid marriage licence (except in the cases exempt from it), and declare their consent before not fewer than 2 witnesses of legal age. If something here is missing, no amount of paperwork later repairs it, because the problem is the marriage, not the file.

Layer two: issuance. Article 23 requires the solemnising officer to transmit a copy of the marriage certificate to the local civil registrar of the place of celebration within 15 days of the ceremony, and within 30 days for marriages exempt from the licence requirement. The record then works its way up to the Philippine Statistics Authority. Only once it lands in the PSA database can a PSA copy be issued to you. Whether it can be pulled depends on whether registration actually happened and whether the names, date and place you supply match the register letter for letter.

Layer three: acceptance. Even holding a PSA copy, the counter in front of you has its own rules: security-paper original or not, apostille or not, what form of translation it recognises, how recently the copy must have been issued. That office is not ruling on your marriage. It is ruling on whether your file is formally complete.

The owners differ at every layer. Layer one belongs to you and your solemnising officer, layer two to the LCR and the PSA, layer three to that particular immigration desk, bank branch or registry. Five Documents People Call a Marriage Certificate, and the One Most Offices Want

At least five different papers get called a Philippine marriage certificate. Offices almost always mean the PSA copy printed on security paper; the other four get handed back at the counter.

The PSA marriage certificate. Pulled from the national civil registry database and printed on security paper, known in the trade as SECPA. The LCR local copy. Issued by the city or municipal civil registrar. In the window between registration and the record reaching the PSA, this is the only copy in existence, and it can carry you for a short while. It is not a substitute: most visa and authentication steps still end up demanding the PSA version. The DFA's authentication requirements note that where a PSA copy is unclear or has erasures, the LCR copy of the marriage registration (Form 3A) is submitted alongside it — as a supplement, not a replacement.

The ceremonial certificate handed out at the wedding. Decorative, signed, and of no registry value. No official use accepts it.

The Advisory on Marriages. What the PSA issues when a marriage record is found on a search. It answers "is there a record", not "are these two married", and the two are not interchangeable at a counter.

The CENOMAR. A certificate of no marriage record, used before the wedding to show the Filipino party is free to marry. Requesting one after the wedding serves no purpose.

The cost of picking wrong varies. Presenting the ceremonial certificate wastes a trip; presenting the LCR copy for apostille is the single most common rejection on this line; presenting an Advisory or CENOMAR as proof of marriage simply will not be accepted. Confirm which document the receiving office wants before you order anything, because working in the other direction almost always means doing it twice. Who Is Legally Free to Marry, and What Has to Be Proved

The conditions are cumulative, not a majority vote. Three clusters: the parties must be free to marry, that freedom must be provable on paper, and the ceremony must happen inside a valid licence with an authorised officer.

Cluster one, the parties. Both must be of legal marrying age, free of any subsisting marriage, and outside the degrees of relationship the law prohibits. Where the Filipino party was married before, that earlier marriage must first be resolved under Philippine law, and the Philippines has no general divorce regime. Article 26, paragraph 2 provides that where a marriage between a Filipino citizen and a foreigner is validly celebrated and a divorce is thereafter validly obtained abroad by the foreign spouse capacitating that spouse to remarry, the Filipino spouse shall likewise have capacity to remarry under Philippine law; in practice this still normally passes through recognition proceedings in a Philippine court. Cluster two, proof of status. Article 21 requires a party who is a foreign citizen to submit, before a licence can issue, a certificate of legal capacity to contract marriage issued by their diplomatic or consular official. Chinese nationals in practice obtain a notarised declaration of no spouse from the Chinese embassy or consulate: the applicant must have full civil capacity, must apply in person and sign before the consular officer, and there is no agent-run version. The embassy's notarial guidance states that a notarisation of marital status is generally valid for six months, so ordering it too early can leave it unusable on filing day. The Filipino party typically supplies a PSA birth certificate and a CENOMAR.

Cluster three, licence and ceremony. Article 17 requires the application details to be posted on the bulletin board outside the registrar's office for 10 consecutive days before the licence issues. Article 20 makes the licence valid throughout the Philippines for 120 days from issuance, after which it lapses automatically. The ceremony must be solemnised by an officer authorised by law, with the parties declaring consent before not fewer than 2 witnesses of legal age.

Who May Request a Copy, and Where Delegation Stops

A PSA marriage certificate is released to persons with a legitimate interest, and relatives or authorised representatives can collect on your behalf. Collecting a copy and "arranging a marriage" are entirely different things, and only the first exists.

The parties themselves. The simplest case: apply through the channel and present identification as that channel requires. The PSA lists 7 pieces of information for a marriage certificate request: the husband's complete name, the wife's complete name, the date of marriage, the place of marriage, the requester's complete name and address, the number of copies, and the purpose of the request. Relatives and authorised representatives. The PSA operates an authorised-requester rule; a family member or representative submits identification for both sides plus the authorisation the channel requires. If you are overseas or simply cannot make the trip, this is the legitimate route.

Correction applicants are a separate list. The PSA's material on RA 9048 sets out who may petition for correction: the owner of the record who is of legal age, the spouse, children, parents, siblings, guardian, grandparents, and any other person duly authorised by law or by the owner (through a special power of attorney). Where the owner is a minor or physically or mentally incapacitated, the petition may be filed by those relatives or a duly authorised person. That list governs changing a record, not obtaining a copy, so do not apply it to the wrong task.

Where delegation ends. No one can marry on your behalf. The Chinese consular declaration must be signed in person before the consular officer, the wedding requires your presence, and whether both parties must appear together for LCR filing and the oath is decided by the receiving city hall. Requirements Change With the Destination Country

One certificate, three destinations, three different follow-on steps. Fix the destination first, then work backwards to what you need to order.

Used inside the Philippines. For a spouse's residence status, a child's birth registration or a bank account, the PSA security-paper original usually stands alone: no apostille, no translation, because the document is already in English. Order by the number of counters you must satisfy. Marriage-based residence status is decided by passport nationality, with mainland Chinese passport holders prepared as a temporary resident visa (TRV, commonly called MCL in the community) rather than 13(a); reciprocity-list passports go the 13(a) route, covered in the 13(a) marriage visa explainer. Sent to mainland China. Two things attach to the PSA original: an apostille from the Philippine Department of Foreign Affairs, and a Chinese translation in the form the receiving office recognises. Since 7 November 2023 the Convention Abolishing the Requirement of Legalisation for Foreign Public Documents has been in force between China and the Philippines, so a Philippine public document within the Convention's scope needs only the Philippine apostille to be used in mainland China, and Chinese diplomatic missions in the Philippines stopped issuing consular legalisation for Philippine documents on the same date. Sent to a third country. If the destination is a Convention party, the apostille route applies. If it is not, or if it objected to the Philippines' accession — the DFA's own FAQ names Finland and Germany — consular legalisation is still required. The Convention also carves out documents executed by diplomatic or consular agents and administrative documents dealing directly with commercial or customs operations.

One rule that must never be reversed: authentication happens in the country where the document was issued. A Philippine public document going to China is apostilled in the Philippines. A Chinese document to be used in the Philippines is notarised in China with an English translation and then carries an attachment certificate from the Chinese foreign ministry or an authorised provincial foreign affairs office; the Philippine DFA does not authenticate foreign documents. Getting this direction backwards is the most expensive mistake on this line.

The Three Things Checklists Leave Out

Everything printed on the checklist gets prepared. What sends people back for another round is the part nobody wrote down: how the name is spelled, how recently the copy was issued, and how many copies you ordered.

Name formatting. Philippine forms carry a middle name field; a Chinese passport does not. In Philippine convention the middle name defaults to the mother's maiden surname, a concept Chinese names have no equivalent for. If the licence, the certificate and the eventual PSA record disagree on even one field, the spouse visa, the bank and the child's birth record inherit the problem. Transcribe letter by letter from the passport and ask the LCR how the middle name field should be filled before anything is signed. Repair afterwards splits two ways: clerical or typographical errors can go through administrative correction under RA 9048, while substantive changes generally require court proceedings, which is a completely different threshold.

Issue date. A PSA marriage certificate does not print an expiry date, but many receiving institutions have their own view on how recently the copy should have been printed, and most prefer a recently issued original. There is no single national standard here, so the receiving office's current requirement governs. Most LCRs also apply a recency rule to the Filipino party's PSA birth certificate and CENOMAR, so ordering too early makes them unusable on filing day while ordering too late misses the wedding. Number of copies. The apostille consumes an original. The spouse visa wants one. A change of marital status back home wants one. An employer or school filing may want another. Photocopies do not substitute for security paper. Ordering several at once is far cheaper in time than chasing them one at a time, and the first copy that arrives should be proofread against both passports before anything else is built on it.

One more question to ask up front: whether the receiving office accepts electronic certificates and electronic authentication. Since 16 March 2026 the DFA has applied fully digital apostille processing to PSA electronic certificates, issuing electronic authentication only for documents bound for Convention parties, and the DFA states that printing it out invalidates it. What cannot be delegated is the marriage itself: the consular declaration is signed in person, attendance at the ceremony is personal, and whether both parties must appear for LCR filing is up to the receiving city hall.
Is the certificate handed out at the wedding usable?
No. It is a keepsake, not a registry document. Visa applications, apostille work and use abroad all require the certificate the PSA issues after the marriage has been registered with the LCR and the record has entered the PSA database.
