Foreclosure Notice on Your Rented Unit: What a Tenant Should Do in the Philippines

Updated 2026-10-14·9 min read·Settling In

A bank notice on the door does not mean you are out tomorrow. Keep paying the current rent, but from today prepay nothing. Work out what stage the notice represents and who issued it, continue paying the landlord with proof until a party with the right to the rent instructs you otherwise in writing, ask the landlord to confirm in writing what happens to your deposit and advance rent, and begin allowing time for a possible move.

Read the notice: which stage is this?

Not every bank notice means the same thing, and the stage it represents decides how much time you have. So the first job is to identify it.

There are broadly four kinds. A demand or default notice tells the landlord the loan is overdue. The property still belongs to the landlord and this is an early warning. A notice of auction sale gives a date and place, is posted in the building or on the door, and means the mortgage is being enforced although no sale has happened yet. A notice after the sale means the bank or a third party has bought the property, usually with a period in which the former owner may still redeem it. A notice to vacate or a court writ of possession is the last step and means the new holder intends to take physical control.

Photograph the entire notice and note the issuing office, any case or loan reference, the date and the contact person. If the English or the legal terms defeat you, preserve it first and get help reading it afterwards.

Then check that it is real. There are scams in which someone posing as a bank or a court posts a notice telling tenants to redirect rent to a new account. Do not call an unfamiliar mobile number printed on the notice. Use the channels on the bank's official website or visit a branch, and in a condominium ask the management office whether it received the same document. For the mortgage and levy entries that appear on a title, see how to read annotations on a Philippine title.

Ask neighbours on the same floor whether they received anything similar. Several units with the same notice usually points to a wider problem with one owner or developer.

Do you keep paying rent, and to whom?

Until a party entitled to the rent tells you otherwise in writing, keep paying the landlord under the lease. Never pay ahead.

Many tenants react by stopping payment on the theory that the unit is no longer the landlord's. That is risky. As long as ownership and possession have not legally changed, the landlord remains the other party to your contract, and withholding rent puts you in arrears and gives them grounds to terminate and claim.

Three rules apply. Pay monthly and on time, never early. A landlord under pressure is short of cash and may offer a discount for several months or half a year up front. Decline. Pay by transfer with the month in the note, not in cash. Post-dated cheques already issued: ask in writing to replace them with monthly transfers. If the landlord refuses, at least keep a list of the outstanding cheque numbers and dates and ask a lawyer whether and how they can be dealt with.

If the bank or the auction buyer writes telling you to pay them from now on, ask first for the basis of their right, such as the registered certificate of sale or a new title, forward the letter to the landlord and ask for a written response. When the two sides contradict each other and you cannot tell who is right, that is the moment to see a lawyer, because paying the wrong party can count as not paying at all. A similar question of who should receive the rent is discussed in when the landlord sells and the new owner wants you out.

Deposit and advance rent: the money most likely to vanish

A landlord who cannot service the mortgage is short of money, which makes your deposit and any advance rent the most exposed part of the arrangement. Get it on paper while the landlord is still answering messages.

Send three questions in writing straight away. What are the amounts of my deposit and advance rent, please confirm. Is it true that the bank has issued a notice on this unit, and what stage has it reached. If the lease cannot run its full term, when and how will you return the deposit and the unused advance rent.

The most practical protection is to agree that the deposit will be applied to the last months of rent. Leases normally forbid this, but where the landlord's own default is likely it is the one arrangement that does not rely on their goodwill later. Record it in a signed addendum stating the month from which the deposit is applied and that neither side has further claims once it is used up. Applying the deposit yourself without written consent will be treated as arrears like any other shortfall.

If the landlord is silent or refuses, gather your proof of payment, receipts and the deposit clause, and pursue the landlord personally through a demand, conciliation or small claims. See when a landlord will not return the deposit and how small claims court works. The bank or auction buyer does not normally take on a deposit you paid to the former owner.

A frank word: when a landlord cannot pay the mortgage, recovering the whole deposit is uncertain. The earlier you negotiate an offset, the smaller the loss.

How long can you stay? The usual outcomes

There is no single answer. It depends on the stage reached, whether the landlord clears the debt, and what the new holder wants to do with the unit.

Outcome one: the landlord pays the arrears or restructures the loan. The notice is withdrawn and life goes on. This happens often enough that you should not give up the lease the moment a notice appears.

Outcome two: the sale takes place and a redemption period begins. The former owner may still redeem. Who holds possession during this period varies. In some cases the former owner stays in possession, in others the buyer applies to take over sooner. For a tenant this is the time to start looking seriously for another place.

Outcome three: title is settled in the name of the bank or the buyer. The new holder can normally ask a court for a writ of possession. A lease signed after the mortgage will generally not stand in the way. Enforcement still follows a procedure with written notice and a period to comply. A person arriving at the door and saying so does not oblige you to leave on the spot.

Outcome four: the new holder is willing to keep you. Banks seldom want to be landlords, but a third-party buyer is sometimes glad to keep a sitting tenant, which means signing a new lease.

In every case, if anyone tries to force you out by cutting utilities, changing locks or removing belongings, record it and notify management. Seeing the matter from the buyer's side helps you anticipate what they will do, and that view is set out in how foreclosed property is bought in the Philippines.

Move now or wait? A way to decide

Three things settle it: the stage of the process, how long your lease has left, and how much of your money the landlord is holding.

You can wait and watch if it is only a default or auction notice, the landlord is communicating and has confirmed in writing that it is being handled, and you have a modest deposit and no advance rent at stake. Start looking if the sale has already taken place, the landlord has gone quiet or evasive, or you have received a notice to vacate with a stated deadline. Negotiate an exit quickly if the landlord holds a large prepayment or a stack of your post-dated cheques and plainly cannot perform.

When you negotiate an early end, your footing is that the lease cannot be performed because of the landlord's own default. The aim is release without penalty plus an agreed treatment of the deposit, not you paying a break fee. For how to conduct that conversation, see when a landlord suddenly asks you to move.

When choosing the next place, use what this taught you. Ask to see the title before signing and look for a mortgage annotation, so that you do not rent into the same risk again. The checks are listed in what to lock down in a Philippine lease. If belongings are damaged during the move, see claiming against a moving company.

When you leave, complete the handover as you normally would: settle utilities, obtain the building's move-out clearance, get a receipt for the keys and photograph the condition of the unit. Even if the landlord has stopped caring, those records stop anyone later claiming you left bills or damage behind.

Five things not to do, and who can help

Tenants in this situation usually lose money by doing one of five things.

One, do not stop paying the current rent without a lawyer's advice or a written instruction from a party with the right to it. Two, do not prepay, however generous the discount. Three, do not send rent to an unfamiliar account named in a notice or text message before verifying identity and entitlement. Four, do not sign a voluntary surrender or waiver you do not understand, especially one that fails to state a refund amount and date. Five, do not help yourself to the landlord's furniture or appliances to make up for the deposit once the landlord has disappeared.

Four kinds of help are available. The management office can confirm whether the notice is real and whether other units are affected. The bank, through its official channels, can confirm the status of the property and its usual approach to existing tenants. The barangay can conciliate a deposit or advance-rent dispute where you and the landlord live in the same city or municipality, as described in how barangay conciliation works. A lawyer is worth one consultation for any question about whom to pay, whether you must vacate and what to do about cheques.

If the unit was leased in a company's name to house an expatriate employee, tell the company's administration or legal team early so that the company handles the contract and the deposit.

Finally, keep a single file of every notice, message and payment from the day the first notice appeared. Whatever route this takes, that file is what lets someone else help you quickly.

Frequently Asked Questions

There is a bank notice on the door. Do I have to move out immediately?
No. First identify whether it is a default notice, an auction notice, a post-sale notice or a notice to vacate, and verify that it is real. When you do have to leave there will be written notice with a period to comply, and enforcement follows a procedure.
Should I keep paying rent to my landlord?
Yes, under the lease and with proof, until a party entitled to the rent instructs you otherwise in writing. Do not prepay. If the bank or buyer asks you to pay them, ask for the basis of their right and speak to a lawyer.
Could I lose my deposit?
It is a real risk. The deposit was paid to the landlord, and the bank or buyer does not normally assume it. Confirm the amount in writing early and negotiate to apply it to the final months of rent in a signed addendum. Otherwise pursue the landlord personally.
I prepaid six months of rent. What now?
Ask the landlord in writing to confirm the amount and a refund plan, and keep proof of payment. If the lease cannot run its term, the unused part is claimed from the landlord through a demand, conciliation or small claims. Prepay nothing further.
Does my lease bind the bank?
A lease signed after the mortgage generally cannot block enforcement of the mortgage, and the new holder can take possession through proper process. Details such as registration and timing matter, so ask a licensed lawyer about your case.
How do I know the notice is real?
Do not call an unfamiliar mobile number on the notice. Verify through the bank's official channels or a branch, and ask management whether it received the same document. Be especially wary of any instruction to pay rent into a personal account.
Can the new owner let me stay?
Yes, under a new lease. Banks rarely act as landlords, but a third-party buyer may be happy to keep an existing tenant. Terms are renegotiated and your old deposit does not carry over automatically.
