Can You Refile After a 9G Is Cancelled? Cancellation, Revocation and Lapse Are Three Different Things

Short answer: whether you can refile depends on which kind of "cancelled" you are in. A cancellation filed by the employer after separation usually does not affect a new application. A revocation on stated grounds has to have those grounds cured first. A lapse caused by employment ending is not a penalty at all.

All three get called cancellation in conversation, but they leave different traces on the record and have different consequences for the next filing.

Three different things with one name

Cancellation. The closing step an employer files after separation — part of the normal process. Employers who skip it carry exposure of their own, see the employer's duty to cancel.

Revocation. The agency decides, on stated grounds, that the permit or the visa should not continue. On the permit side Department Order No. 248, series of 2025 lists grounds, including failing without valid reason to claim the card within 10 working days of the issuance notice, or not submitting pre-release documents.

After a clean cancellation: refiling is standard, with two conditions

A proper cancellation leaves a complete compliance record, not a blemish. Moving to another qualified employer and running permit and petition again is the standard path.

First condition: it actually has to have been filed. The employer reports separations and other material changes within 10 calendar days, with cancellation requests going to the designated mailbox in the prescribed subject format. Unfiled cancellations tend to surface when the next employer files.

After a revocation: cure the ground before discussing refiling

The question is not how long you must wait, but whether the ground has genuinely been cured. While it stands, rebuilding documents produces the same outcome.

Locate the ground. If it sits with the employer — corporate standing, tax filings, workforce composition documents — moving to a qualified employer is often more realistic than repairing in place. If it sits with the applicant — credential mismatches, unresolved record items — fix the documents first.

After a lapse: no penalty, but a tight window

A lapse leaves no penalty record; what is tight is the authorised stay remaining in your passport. Once the status ends, that stamp is all the lawful stay you have.

Four things to verify before refiling

Verify the real status of the previous file — cancellation, revocation or lapse — from the agency record, not from what the company says. Lookups are in how to check a 9G and a permit.

Verify remaining authorised stay. The checklist expects at least 30 days remaining at assessment, and a short stay stops the file at intake.

Verify the new employer qualifies. Registration, tax and annual filing standing form the first gate — see the three tests.
