Philippines Certification of Medical Devices: There Is No Single Certificate
Philippines certification of medical devices is not one document. Legal market access is two FDA authorizations stacked on each other: a company-level License to Operate (LTO), and a per-device product authorization held under it — a CMDN on the notification route, a CMDR on the registration route. Anyone offering you "the Philippine certificate" is describing one of those two.
The word is worth pulling apart first, because buyers, tenders, freight forwarders and factories all use "certification" for three different things:
- Philippine market authorization — the LTO plus the CMDN or CMDR. This is the only pair that makes a device legal to import and sell here. The trade often calls it the marketing authorization or the CPR, and it is what the rest of this guide is about.
- Manufacturer-side quality certificates — ISO 13485, a CE certificate, a US FDA 510(k) clearance, a Certificate of Free Sale from the country of origin. These are components of your Philippine filing: missing them stops the file, but holding them does not let you sell.
- Consignment-level clearance — the paperwork that releases a specific arriving batch of regulated health goods. It is issued against your standing product authorization, not instead of it.
There is one structural point that European and Chinese suppliers almost always assume wrongly: the Philippines has no third-party certification layer. The EU model — a notified body issuing certificates, the manufacturer self-declaring and applying a CE mark — does not exist here. Only the Philippine FDA can authorize a device for this market. No commercial laboratory, testing house or consultancy can issue a "Philippine certificate" in its place, and a quotation offering one is selling filing services, not a certificate.
So if your question is "how do I get my device certified in the Philippines", the honest answer is: establish what the product is and what class it falls in, stand up or borrow an LTO, then file the notification or the registration that the class dictates — in that order, because the license holder is the applicant.
Certification, Registration, Notification, License: Which Word Means What Here
In Philippine device practice these four words are not synonyms: the license describes a company, registration and notification describe a product, and "certification" has no legal object of its own — it is a loose umbrella term. Two parties can spend an entire negotiation believing they are discussing the same document while being a whole workflow apart.
- License — the License to Operate (LTO). Issued to a company for a declared activity: manufacturer, importer, distributor or wholesaler, trader. It is tied to a declared and inspectable warehouse and a qualified technical person, and it says nothing at all about any specific product.
- Registration — the CMDR. Issued to a product, on the strength of a full technical dossier and a substantive assessment. This is the route for higher-risk devices.
- Notification — the CMDN. Also issued to a product, on the lighter route used for lower-risk devices. Lighter is not laxer: the technical file still has to exist and still has to survive being called in, it simply is not assessed to the same depth at submission.
- Certification. In the Philippine device context there is nothing this word points to on its own. When a buyer says "send me your certification" they usually want a scan of the CMDN or CMDR. When a factory says "we are certified" they usually mean ISO 13485 or CE. Those are two different documents, and that gap is where tenders and supply contracts fall apart.
Worth a comparison: the Philippines does operate a genuine product certification scheme — just not for devices. The DTI Bureau of Philippine Standards issues the PS and ICC marks for a defined list of mandatory products, and that really is certification in the strict sense. Practical habit: when you talk to anyone on the Philippine side, replace the word "certification" with whichever of LTO, product registration or notification you actually mean. And when someone says "certification" to you, ask once — "do you want the CMDN or CMDR, or the manufacturer's ISO and CE certificates?" It surfaces the real requirement almost every time.
The LTO: The License Belongs to a Company, Not to a Device
The License to Operate is issued to an establishment for a declared activity, not to a machine, and it has to exist before any product application can be filed — because the license holder is the applicant. Without it you cannot even reach the submission counter.
It governs three things:
- What you actually do. The activity on the license — manufacture, import, distribute, trade — has to match your real operations. Declaring yourself an importer while repacking or relabeling locally is one of the most common findings in an inspection.
- Where the goods sit. The declared warehouse is a physical address that can be visited, with storage conditions appropriate to the product, traceable receipt and release records, and — for temperature-sensitive lines — monitoring and backup power. The warehouse is frequently the slowest item on the whole timeline, not the paperwork.
- Who is technically accountable. A qualified technical person is required, and the role is not a signature. Qualifications and experience are reviewed, and an unfilled post holds up the license.
Two scheduling points on validity and renewal. The LTO term is tiered by establishment size and has been revised by administrative order more than once in recent years, so do not import somebody else's timeline from a few years ago — confirm the term in force when you apply. And the renewal window opens before expiry: letting a license lapse is not a matter of catching up late. Past the grace period the license can be terminated, which means starting again as a new application while every product authorization sitting under it loses its footing at the same time. CMDN, CMDR and the CPR: Which Certificate Your Device Ends Up Holding
Which certificate you receive is decided by risk class, not by preference. Lower-risk devices travel the notification route and receive a Certificate of Medical Device Notification (CMDN). Higher-risk devices travel the registration route, with a full technical dossier and a substantive assessment, and receive a Certificate of Medical Device Registration (CMDR). Commercially the two do the same job: each is the marketing authorization for that device.
So where does the CPR fit? Certificate of Product Registration is the FDA's generic, cross-category term — food, cosmetics, supplements and drugs all end in a CPR, and the trade habitually calls a device's product authorization a CPR as well. In the device lane, though, the paper in your hand normally reads CMDN or CMDR. When a tender asks you to "attach the CPR", the CMDN or CMDR is what you attach; there is no separate device certificate called a CPR to go hunting for.
Three things worth pinning down:
- The class is argued, not looked up. The Philippines follows the ASEAN Medical Device Directive framework and its A/B/C/D scale, and the class is derived from intended use — invasiveness, duration of contact, whether the device is active, whether it measures or diagnoses, and the consequence of failure. Your marketing copy does not decide it; the intended use written into the dossier does. - The notification-versus-registration boundary moves. The current framework was established by FDA administrative order in harmonization with the ASEAN directive and is amended by circular, and categories have historically been migrated out of notification into registration with transition windows. "Our device only needed a notification last time" is a hypothesis, not a plan — confirm against the issuance in force on your filing date rather than a number lifted from a slide deck.
- How many models one certificate covers depends on grouping. Whether variants in a family can be filed together is a separate determination. Get it wrong and you either pay for redundant applications or, worse, end up with a certificate that does not cover the models you are actually shipping — which surfaces at customs and in tender evaluation, not at the FDA.
IVD Certification Philippines: The Same Two Layers, a Different Rulebook
IVD certification Philippines is structurally identical to device certification — an LTO plus a CMDN or CMDR — but in-vitro diagnostics are classified under their own rules and assessed on their own kind of evidence. Which is why "we already hold a device LTO, so we will just add the test kits" is usually half right and half expensive.
The difference comes from what the product is. An IVD never touches the patient. It acts on a specimen taken out of the body and returns information, so the harm it can do is informational rather than mechanical: a reagent does not perforate or fail structurally, it produces a wrong number or a wrong line, and the damage arrives through the clinical decision built on top of it. From that one fact:
- The classification rules differ. The scale still runs A to D, but the questions are diagnostic ones: what follows a wrong result, whether there is a public-health dimension such as blood or donor screening, whether the user is a layperson self-testing or a trained medical technologist, and whether the result stands alone or is always confirmed. A Class B IVD and a Class B instrument reach the same letter by entirely different reasoning.
- The dossier contains different things. Nobody asks a reagent kit for biocompatibility or fatigue data. Reviewers want analytical performance, clinical performance, cut-offs, reference intervals and stability.
- The failure points differ. Devices tend to stall on electrical safety and instructions for use; IVDs tend to stall on cold chain — temperature excursions, remaining shelf life, logger records on arrival.
The vocabulary is messy too. Buyers ask for it as IVD certification Philippines, regulatory consultants call it IVD registration, and suppliers searching for IVD certification in Philippines land in exactly the same place. All three describe the same pair of authorizations. Do ISO 13485, CE Marking and a US FDA 510(k) Count in the Philippines?
They count as evidence, never as permission. None of them lets you sell a device here. But a file missing them will not be accepted either — ISO 13485, or an equivalent quality-system audit report from a recognized authority, is a required component of the submission rather than a bonus. That is the complete answer to "do foreign certificates work in the Philippines": not useless, not sufficient — necessary but not enough.
- ISO 13485. It has to cover the actual manufacturing site and the product scope you are filing. Three recurring rejections: the certificate has expired; the site on the certificate is not the manufacturing address on the application; the scope does not include the product line being filed. Where a manufacturer has no ISO 13485, an audit report from a recognized regulatory authority is normally what stands in its place — not a self-declaration.
- CE certificates and the EU declaration of conformity. Accepted as evidence of conformity in the origin or principal market, and useful for shortening arguments during assessment. Note that the EU's own MDR transition means legacy certificates increasingly attract questions about status and validity, and that model names and catalogue numbers on the certificate must match the Philippine application word for word.
- US FDA 510(k) clearance or PMA approval, and a Certificate to Foreign Government. Supporting documents demonstrating the device is authorized in its home market. They create no automatic recognition pathway into the Philippines.
- Certificate of Free Sale from the country of origin. Routinely required to show the product is freely sold at home. Watch its validity date — an expired CFS is one of the most common and most avoidable reasons a file comes back.
- Devices already approved by an ASEAN member state's regulator may be handled faster in practice, since the region shares the AMDD framework and the CSDT dossier structure. It is still a full filing, not an exemption.
One badly underestimated item: foreign-issued free-sale certificates, letters of authorization and quality-system certificates generally need notarization plus apostille or consular legalization. The Philippines is a party to the Apostille Convention, so documents from fellow member states take the apostille route while others still go through consular authentication. The length of that queue, not the technical assessment, is usually what sets your real start date — legalization can run for weeks before a reviewer has opened anything. The section in one line: a CE mark on the carton shortens the Philippine process by exactly zero days, while an expired ISO 13485 certificate stops it entirely.
Whose Name Goes on the Certificate — and When That Bill Arrives
Both the LTO and the product certificate are issued to the Philippine license holder, so whoever holds them holds your market access. A foreign manufacturer with no local entity can absolutely get a device registered here — but the certificate will not be in its name.
There are only two shapes:
- Your own Philippine entity holding its own LTO. You own the registrations and control pricing, channel and any change of distributor, and you carry the post-market duties yourself. It is slower to stand up — incorporation, warehouse and technical person all have to be real — but nothing is hostage.
- An appointed local authorized representative or importer that already holds a device LTO. The fastest way in, and it can run in parallel with your own incorporation so you do not lose the launch window. There is exactly one cost, and it is heavy: the registration sits in their name.
The sentence most often skipped in the second arrangement is this: moving the certificate into your own name later is a re-filing, not an edit. Re-filing means re-queuing, re-assessment and waiting — and during that gap you cannot sell in the Philippines at all. If the distributor relationship sours, the other side does not have to do anything hostile; simply doing nothing suspends your market access.
So three clauses belong in the first contract rather than in the argument two years later: a transfer clause (the conditions under which they must cooperate with a transfer, and how quickly), a termination and transition clause (what happens to the letter of authorization, to stock on hand and to goods in transit), and a records handover clause (who keeps the technical file, the submission records and the FDA correspondence). They cost nothing to negotiate and are worth the whole market when you need them.

After the Certificate: Validity, Renewal, Change Control and Post-Market Duties
A device certificate is a term authorization carrying continuing obligations, not a one-off pass. Four things have to keep happening: renew on time, report changes, keep the technical file current, and be able to reconcile every consignment against the certificate at the border.
- Renewal. The product authorization and the LTO each have their own validity and their own renewal window, and the two are not synchronized. The workable practice is to put both expiry dates on one compliance calendar and file on the day the window opens — because if the LTO drops, every product authorization sitting under it loses its basis at once.
- Change control. This is the most-skipped and most-expensive item. A changed manufacturing site, a changed legal manufacturer name or address, a changed formulation or configuration, a redesigned label, a replaced authorized representative — all are reportable. Changing quietly after filing and hoping nobody notices is far worse than a slow approval: at best the certificate's status is affected, at worst a shipment is held at the port.
- Post-market obligations. Adverse event reporting, recalls and field safety notices, complaint handling and traceability records all sit with the license holder, and the declared warehouse can be inspected. The records have to survive being read.
- Labeling. The label must carry the Philippine license holder's name and address, and the notification or registration number once granted. It must not promise more than the dossier proved — an extra indication, a broader claim, a longer shelf life are all self-inflicted rejections.
Then there is the border. An authorized device still clears as regulated goods. The entry must be lodged by a party entitled to do so; the FDA license and product authorization must be referenced and must agree with the commercial invoice and packing list on product names, catalogue numbers and quantities; and shipments of regulated health products routinely require a consignment-level clearance in addition to the standing authorization. A product description on the invoice that does not match the authorized product name is the classic hold — nothing is missing, the two documents simply do not read the same. Which Document Do You Actually Need? Answer These Five in Order
Do not open with "how much and how long". Answer five questions in sequence and the route falls out by itself. Get any one of them wrong and everything after it is wasted work.
- Is it a medical device under Philippine rules? Decided on intended use, not on your marketing copy. Borderline categories are where projects die: skincare gadgets with therapeutic claims, wearables claiming diagnostic support, general laboratory equipment, software as a medical device. Get the category wrong and the whole path is wrong.
- What class is it? A, B, C or D decides notification versus registration, dossier depth and assessment time. The class is derived from intended use and needs a defensible argument, not an assertion that "we consider it Class A".
- Whose name will the LTO be in? Your own entity or an appointed authorized representative — this has to be settled before the first submission, because the license holder is the applicant and changing it afterwards is a re-filing.
- Do the foreign documents exist, and do they reconcile? ISO 13485 site and scope, CE or 510(k) model numbers, CFS validity — check each line against the application. Fix mismatches before filing rather than hoping a reviewer lets them pass.
- What needs legalization, and when does that queue start? Apostille or consular authentication is usually the longest hidden path in the project and should start while the technical file is still being assembled.
On timing and cost, both are mechanisms rather than numbers. Duration depends on the class and route, the completeness of the file on day one, whether the FDA issues a deficiency letter — answering one typically restarts a clock rather than continuing it — and on the legalization queue abroad. The LTO runs on its own timeline and generally has to finish first. Fees vary by class, route and elected validity term under the FDA's current fee schedule, with separate charges for the LTO and for consignment-level clearance, and legalization, translation, any required local verification testing and professional fees on top. Anyone quoting you a fixed approval date, or promising that approval is guaranteed, is describing a hope rather than a process.
