This is not lawful
Common justifications and the reality: safekeeping requires your consent and immediate return on request; visa filing may involve temporary submission to Immigration with a receipt and prompt return; retention to stop you leaving is control of a person through documents. Simple test: you asked, they refused or stalled.
Before you ask: preserve evidence
- Make the request in writing and keep the reply
- Have photos of the bio and visa pages
- Keep employment evidence
- Note potential witnesses
You can open non-confrontationally — say you need it for banking or medical purposes — but keep it in writing.
Agencies to approach
- DOLE for employment-related complaints
- Your embassy or consulate — consular assistance and document replacement
- PNP if there is any restraint or threat
- BI where illegal employment is involved
- PAO for free legal aid if eligible
If it cannot be recovered
You can report it and apply for a replacement. Once the old passport is reported and cancelled, it loses value — which removes their leverage entirely. Afterwards, reconcile your visa records with Immigration.
Seek help immediately if these appear together
- Restricted movement or guarded premises
- Phone confiscation or monitored communication
- Threats against you or your family
- Work different from what was agreed, or unlawful work
- Demands for payment of "debts" or "training fees" to leave
These are indicators of forced labour. Prioritise personal safety and contact your consulate, local police or anti-trafficking authorities. Do not confront alone.
