Who an SWP suits and who it does not
The SWP is formally a Special Work Permit. It is not a visa but a permit the Bureau of Immigration issues to holders of a temporary visitor visa who will do short-term paid work in the Philippines. Check where you fit:
- Suits: work measured in months that ends when the job is done, such as equipment installation and commissioning, system go-lives, targeted training, performances or events, and short technical support; some office charters describe applicants as foreigners who will do three to six months of paid work.
- Not for long-term roles: if the work will run beyond six months or is ongoing employment, start with the AEP and 9G from day one.
- Not for working while a 9G is pending: if the AEP and 9G are already filed and you only want to start early, the tool is the provisional work permit (PWP), not the SWP.
- Not for switching companies to get another: the charter says the six-month cap applies regardless of position, promotion or a change of petitioning company.
- Not without a local sponsor: the applicant is the Philippine company; without a willing sponsor with complete papers, the route does not move.
In one line: short work that ends uses an SWP, long-term employment waiting on the visa uses a PWP, and long-term formal employment ends in an AEP plus 9G.
Who applies for an SWP: the company is the petitioner, you are the beneficiary
The point most often reversed: the applicant is the local host or employer, called the petitioning company in the charter, and you are the beneficiary. That decides who prepares what, and it means the route stalls if the company will not cooperate.
- The company carries: a letter to the BI Commissioner in its name; a sworn certification stating whether this is the first or final SWP, that documents are genuine and that you will only do the stated job; and a sworn undertaking to withhold and remit tax on all your income to the BIR.
- You need: to be in the Philippines on a valid temporary visitor status, and to sign and provide your passport and arrival record.
- One person, one sponsor, one job: a new project, a new host or a material change in duties needs a new application.
An SWP generally does not require a DOLE AEP first, which is the quickest way to tell it from a PWP: if no AEP step has started, you probably need an SWP; if the AEP and 9G are filed and pending, you need a PWP.
SWP application process: from choosing the tool to collecting the permit
The process is not complicated; the hard part is choosing the right tool, finding the right office, and getting the company to deliver its share on time. In order:
- Confirm the tool: will the work exceed six months? If so, go straight to AEP plus 9G; if not, continue.
- Confirm the office: the SWP has no service block in the charter's Main Office section; regional and field offices list it separately, with different classifications, checklists, committed times and even eligibility conditions. Settle which office covers the worksite and company, and ask whether it receives only or receives and processes.
- Company documents: the letter, registration and tax papers, Mayor's Permit and the two sworn documents.
- Your documents: passport pages, latest arrival record, proof of valid visitor stay, and a service or employment document stating period, pay and duties.
- File and pay: take the order of payment, pay, and collect the official receipt, following the items listed by the receiving office.
- Collect and check: the permit names you, the sponsor and the authorised work; check name, employer, position and validity on the spot.
Do not start work before the permit is issued; filing is not approval. Watch your visitor stay separately throughout and extend it when due.
What documents an SWP needs: ten standard items for the commercial category
The 2026 BI Citizen's Charter lists ten standard documents for a commercial SWP; sorting them by issuer is the surest way not to miss one.
- From the petitioning company: the original letter to the BI Commissioner; copies of its income tax return and proof of payment; the original Mayor's Permit; the sworn certification on first or final SWP, genuineness and job-specific work; the sworn tax-withholding undertaking (stating so if all pay comes from an overseas parent).
- From the applicant: the completed consolidated application form (CGAF, shared by non-immigrant visas, SWP and PWP; use BI's current version); copies of the passport bio page, entry visa if any, latest arrival record and current visitor visa or authorised stay; a TIN card or TIN proof.
- Joint: a confirmed service contract or a secretary's certificate of appointment, appointment letter, assignment or secondment document stating period, compensation and duties.
- From BI: an original BI Clearance Certificate.
Consultant and specialist roles carry an extra bar: the charter requires the applicant to be at least twenty-five, with diplomas or certificates of completion certified by the HR manager or an authorised officer, plus training certificates, course completion records or a CV. A consultant title may sound better, but it brings age and education proof. Office checklists differ slightly; follow the current list of the office where you file.
How many times an SWP can be renewed: three months, one final extension, six months maximum
The charter definition is clear: an SWP has a maximum validity of six months, an initial three months plus one final three-month extension. The extension is called a final extension; there is no third period.
- Renewal is not automatic: you refile and pay again with essentially the same documents, and a missing item means return; start with a margin before the first period ends rather than in the final week.
- After that it ends: to keep doing the same work, the only compliant route is AEP plus 9G with a PWP while waiting; otherwise stop working and stay or leave within your visitor status.
- A new company does not reset it: the cap does not restart with a new position or sponsor.
Where it sits against the 9G and PWP: the SWP and PWP are both BI permits that only make the work lawful and leave your visitor status unchanged; the 9G is the pre-arranged employment residence status and needs a DOLE AEP first. The SWP ends with leaving the job; the PWP ends when the 9G is decided. Validity, renewal and what to do after expiry are in SWP validity and renewal; the 9G main route is in the 9G work visa process.
Doing an SWP yourself or using help: which steps you or the company must do
An SWP has no individual self-application route; the petitioner must be the sponsoring company. The real choice is whether the company runs it in-house or hands the delegable parts to an agent.
- Only you: sign the form, provide your passport and arrival record, keep a valid visitor stay and extend it on time, and not start work before approval.
- Only the company: issue the letter in its name, execute the two sworn documents, provide tax returns, payment proof and the Mayor's Permit, sign a contract stating period, pay and duties, and carry the sponsor's responsibility.
- Can be delegated: deciding between SWP, PWP or 9G, confirming the office and its current list, checking and ordering documents, filing and payment runs, progress tracking and renewal reminders.
Questions to settle before delegating:
- Will they ask for the total length of the work first and recommend the main route if it exceeds six months, rather than selling an SWP?
- Which office you fall under, and its current checklist and committed time, verified before documents are collected.
- Who drafts the two sworn documents and the tax undertaking, and whether the company signatory's authority is complete.
- Who tracks the visitor-stay expiry and the permit expiry, and how reminders are sent.
- Whether they promise an outcome or a number of days. BI decides; for what to do after a refusal, see what to do if an SWP is refused.
