How Long Is an SWP Valid in the Philippines? 3 Months, Capped at 6, Straight From the Charter
The Bureau of Immigration (BI) repeats the SWP validity rule almost word for word in its 2026 Citizen's Charter. The permit is issued to a foreign national "who shall engage in gainful employment for three (3) to six (6) months" (CC2026 p.723, Batangas block; p.1184, Laoag block). Its structure is "six (6) months, consisting of an initial three (3) months renewable for a final three-month extension, regardless of the position" (CC2026 p.819, Cagayan de Oro; p.858, Calapan). The Makati Extension Office phrases it as "good for 3 months during the initial application and extendible for another 3 months" (CC2026 p.3268), while the Clark and Subic one-stop shops add "not exceeding six (6) months, non-renewable" beyond that (CC2026 p.3386, p.3450).
Put together, the whole timing rule is:
- Initial term: 3 months, counted from the date of issuance, not from your arrival.
- Extension: 1 only. The charter calls it a "final extension", which already tells you there is no third leg.
- Cap: 6 months for the same engagement. BI's supplemental guidelines of February 2019 require the employer to submit a notarized certification stating whether the application is an initial SWP or an extension, and that the worker will serve only in the position applied for (as reported by Fragomen, 15 Feb 2019). That certification now sits in the district checklists: the petitioner must state under oath "whether initial or final Special Work Permit" (CC2026 p.725).
One more line that people miss: the SWP does not change your immigration status. Your lawful stay still rests on the 9(a) tourist visa and its extensions. The Dumaguete block says it plainly: holders "must continue to extend their tourist stay separately if it expires during the permit's validity" (CC2026 p.2351). Two clocks run in parallel; breaking either one is a violation.
Two words in those blocks deserve attention. "Gainful employment" is what the permit covers; it does not turn a 9(a) into a work visa, and it does not cover a second employer or a second role, which is why the sworn certification names one position and one petitioner. "Final" is BI's own word for the second 3 months. When an office describes the permit as "non-renewable" it is not contradicting the 3 + 3 rule; it is saying that after the final extension there is nothing left to renew. Reading those two words correctly settles most of the questions people bring to us about SWP duration.

How Many Times Can an SWP Be Renewed? Once, and It Is Not Automatic
"Renewable once" sounds simple. The problems are in the details:
- The extension is a fresh filing with fresh fees. BI's Directory of Transactions lists "SWP Extension" as a separate service at the Dumaguete office. The paperwork mirrors the initial application: company request letter, CGAF form BOC04.QF.002, passport bio-page and latest arrival stamp, a valid stay extension, employment documents, TIN proof, BI Clearance Certificate, SEC or DTI registration, mayor's permit (CC2026 p.723-725). One missing item and the file is returned.
- File before the initial term ends. The charter does not print a lead time for SWP extensions, but for 9(f) student visas the same charter demands filing "at least one (1) month prior to visa expiry" (CC2026 p.282). Work to the same rhythm: start the extension 30 days out and leave room for the office's 1 to 7 working days.
- Six months is the end. To keep the same job you must move to AEP + 9G with a PWP as the bridge (see the 9G work visa and AEP guide). Under the 2019 supplemental guidelines the 6-month cap is read within a 12-month period; filing a "new" SWP under a different label after the cap is exactly what those guidelines were issued to stop.

How Long Does an SWP Take? Same Day to 7 Working Days, Depending on the Office
This is where the charter is more honest than any guide. The SWP has no service block in the Main Office section at all; it appears only in district and field offices, and each office reports its own total processing time:
- Batangas District Office: 1 working day, 1 hour 30 minutes (CC2026 p.727)
- Cagayan de Oro District Office: 3 working days, 1 hour 43 minutes (CC2026 p.819)
- Cebu District Office: 5 working days, 23 minutes (CC2026 p.1004)
- Makati Extension Office: 6 hours 26 minutes (CC2026 p.3268)
- Baguio District Office: 3 working days, 57 minutes (CC2026 p.3855)
- Iligan Field Office: 7 working days, 25 minutes (CC2026 p.2427)
- Olongapo Field Office: 24 minutes (CC2026 p.2804); Bohol Field Office: 30 minutes (CC2026 p.1965)
These are ARTA service commitments that assume complete documents and no derogatory record. They exclude your own preparation: the company letter, the notarized certification and the BI Clearance Certificate take days on their own. A realistic plan is 1 to 2 weeks of preparation plus the office's 1 to 7 working days. Whether your city can finish the permit locally is covered in which BI office can process what.
"Working day" in these commitments means a BI business day, so weekends, national holidays and the local holidays of the province where the office sits do not count. An office that promises 3 working days in the week of a long weekend is, in calendar terms, closer to a week. The Makati Extension Office and the one-stop shops inside economic zones are the fastest on paper, but Makati receives only files from Top 1000 corporations and BOI-registered companies, and the zone offices serve the companies located there. For everyone else, the district office with jurisdiction over the employer's address is the realistic choice, and the district commitments cluster at 1 to 5 working days.
How Much Does an SWP or PWP Cost? No National Price, Each Office Has Its Own
Be clear on this: the 2026 charter contains no single nationwide SWP or PWP fee. The Main Office section has no SWP or PWP block, and the district totals disagree. For SWP: Batangas PHP 7,440 (PHP 5,440 miscellaneous + PHP 2,000 express lane + ACR I-Card at USD 50, CC2026 p.727); Cagayan de Oro, Makati, Angeles and SM North PHP 7,470 (CC2026 p.819, p.3268, p.1657, p.3193); Laoag, Tacloban, Bacolod and Baguio PHP 8,470 (CC2026 p.1184, p.1531, p.1847, p.3855); Iloilo and SM Aura PHP 6,440 (CC2026 p.1128, p.3154); Boracay and Kalibo as high as PHP 12,940 (CC2026 p.2017, p.2489). The "PHP 6,440 + USD 50" table on BI's SWP web page carries a footnote that fees were updated as of 6 March 2014. It happens to match some 2026 district figures, but it is not a national standard. The right move is to budget from the assessment slip of the office that will receive your file. Two things to take from the table. The two official documents can disagree on the same office (Santa Rosa's PWP), so a phone call before travelling is the cheapest step in the whole process. And the PHP 2,000 express lane fee is mandatory everywhere; the charter offers no "regular lane" for SWP, so do not budget PHP 5,440.
What sits inside those totals is fairly consistent even where the totals differ. The Batangas breakdown is the clearest: PHP 5,440 in application and miscellaneous fees, PHP 2,000 in express lane fees for filing and certification, and the ACR I-Card at USD 50 converted at the Bangko Sentral rate on the day of assessment (CC2026 p.727). Offices that print PHP 8,470 are generally folding the I-Card conversion into the peso total; offices that print PHP 6,440 or 7,470 are showing the peso components only. The gap between PHP 6,440 and PHP 8,470 is therefore mostly presentation, not a different tariff, while the Boracay and Kalibo figures of PHP 12,940 appear to include additional items and should be checked at the counter before you rely on them.

Working After the SWP Expires: Legally It Is Work Without a Permit, Not Just an Overstay
Many people read an expired SWP as an "overstay" and expect to settle it with a few hundred pesos. The two are different problems:
- Overstaying concerns the 9(a) stay. It is fixed by a late extension plus a PHP 500 monthly fine and a PHP 500 motion for reconsideration (CC2026 p.579).
- Working without a permit concerns whether the SWP is valid. The moment it lapses you are back to "employed on a tourist visa", which is legally no different from never having held an SWP. You can breach both at once: an expired SWP plus an expired 9(a) is the worst combination, because BI reviews the overstay record before anything else. The charter sorts overstays into three approval tiers: up to 6 months handled by the Tourist Visa Section, 6 months and 1 day to 12 months requiring the Chief of the Immigration Regulation Division, and beyond 12 months or beyond the maximum allowable stay requiring the Commissioner, with an official processing time of 10 working days or more (CC2026 p.351, p.356, p.365). The longer it runs, the further your case moves from the counter.

Can an Expired SWP Be Fixed? Three Situations, Three Routes
The charter has no "late SWP renewal" service; for SWP it lists only issuance and one extension. In practice a lapse is handled in one of three ways:
- Situation 1: the initial term just ended and the job finishes within 6 months anyway. File the extension immediately (it is still the one and only extension) and straighten out the 9(a) stay. The gap between expiry and filing is not covered by any permit; the company's sworn certification must state the dates honestly. Whether the office accepts it and whether it charges extra is an office-level assessment; the charter prints no fixed rule, so follow the receiving office's current practice.
- Situation 2: the 6 months are used up. There is no third SWP. The only compliant path is AEP + 9G with a PWP bridge (a PWP is likewise 3 months initial, extendable once, 6 months total, CC2026 p.813, p.2798). - Situation 3: both the SWP and the 9(a) have expired. Fix the stay first: late extension, overstay fines, the approval tier that matches the length of the overstay. Only then can a work permit be discussed. In the reverse order BI will not accept the file.
All three routes share one precondition: stop working first. Continuing while you fix it extends the violation from the past into the present.
Whichever situation applies, document the gap rather than paper over it. BI's own records already show the SWP issuance date and the 9(a) admission and extension dates, so a certification that pretends the work never stopped is easy to disprove and turns a curable lapse into a misrepresentation issue. A short, dated explanation from the petitioning company, together with proof that work stopped on the expiry date, is what an evaluating officer expects to see. It will not erase the gap, but it keeps the file in the ordinary track rather than the Legal Division's.
Linking the SWP to 9G and AEP: When to Stop Renewing
There is only one test: will the engagement exceed 6 months? If yes, start with AEP + 9G from day one and bridge with a PWP, not an SWP. A PWP requires the AEP or 9G application receipt (CC2026 p.709) and has the same 3 + 3 month structure (CC2026 p.813). The difference is not the length but the destination: an SWP ends in leaving the job, a PWP ends in a 9G approval.
If you are already on an SWP and the job stretches, start the AEP no later than month 4. Both DOLE's AEP and BI's 9G run in weeks, and you need at least the 9G filing receipt before day 180 to qualify for a PWP. A caution on cost: the 2026 charter does not publish 9G fees at all. In all 116 9(g) service blocks the "Total Standard Fee" field is blank, so no Chinese-language figure for "official 9G cost" can be verified against this document; use BI's assessment slip at the time.
Finally, the employer side. In the charter the applicant for both SWP and PWP is the "petitioning company", which certifies under oath for every issuance and extension (CC2026 p.725) and carries the matching responsibility. Companies with several foreign staff should put each person's SWP expiry, 9(a) expiry and ACR I-Card expiry on one HR calendar with a 30-day reminder. It costs far less than the fix.
A worked example makes the sequencing concrete. Suppose the engineer arrives on 1 March and the SWP is issued on 10 March. The initial term ends on 10 June, so the extension file should be complete by 10 May. If by then the project is clearly running into the autumn, the company files the AEP with DOLE in May, files the 9G with BI as soon as the AEP is in hand, and applies for the PWP on the strength of the 9G receipt before 10 September, the day the final SWP term ends. The engineer never works a day without a permit, and the 9(a) is extended on its own schedule throughout. Reverse any two of those dates and there is a gap.
