Short answer: it depends on which kind of item is missing
BI's front-line check is a formal review: the officer compares your file with the checklist, and a missing item is returned on the spot, before a case number is even generated. 'File first, top up later' rarely works for a 9G, and what you lose is a full round of queuing.
Missing items fall into three groups:
- Must-have: the AEP card from the Department of Labor and Employment (DOLE). Without it, the 9G filing does not get in.
- Has a substitute: where the position is excluded or exempt, a Certificate of Exclusion or Exemption is filed instead; on AEP renewal, an affidavit of undertaking can replace the newspaper publication and training plan.
- Counter-dependent: professional-regulation permits, sector authorisations and quarantine medical papers depend on what the counter requires at the time.
Remember that in BI's file the employer is the petitioner and the employee only the beneficiary. Documents split by issuer into four sets: the applicant, the employer, the AEP from DOLE, and BI's forms, with most of the weight on the company. See the four-way checklist and the full 9G process.
No AEP card, no 9G filing
The order is set by the two agencies. DOLE answers whether the position should go to a foreigner; BI then decides whether this person may hold a resident status. Without the first answer there is nothing to ask the second, so the AEP is a no-card-no-filing item, not something to add later. The AEP examines the position, meaning why the role has to be done by a foreigner, not the person. Three variants come up constantly:
- The AEP is still under review; can I queue the 9G? No. Without an issued AEP card, the formal screening fails.
- Can I use the AEP receipt? Practice varies by office and period, but treating it as routine is high risk, and a returned file costs a full round of queuing. Any leniency depends on BI's current practice at the counter.
- What else does a first-time conversion need? The AEP is newly obtained, and the filing attaches its actual publication or a publisher's certificate of publication.
Holding an AEP does not mean you may start working: it settles the position only. Before the 9G is approved, the proper route is a provisional work permit (PWP); see the legal routes to working in the Philippines and the AEP guide.
Company documents: current-year versions that agree with each other
BI wants current-year versions of the company's documents, and an extension cannot reuse last time's set:
- Registration papers: the SEC registration, articles, and the current-year GIS with the SEC received stamp; a sole proprietorship needs its DTI business-name certificate. The current-year Mayor's Permit is also needed.
- ITR and proof of payment: the latest ITR plus an official receipt, bank-validated slip, BIR eFPS printout or similar evidence. For a newly formed company not yet at its filing period, follow BI's current position.
- Notarised headcount statement: foreign and Filipino employee numbers, signed in the original by the applicant and the employer's authorised representative.
- Employment contract: exact pay, term and a full description of duties.
- Signing authority and position description: settle who may sign in advance; the position description is the core of the AEP justification and must match the contract.
More subtle than a missing paper is a paper that does not match: the title and pay in the contract must line up with the AEP position and the tax withholding, and one mismatch causes trouble at both agencies. After a change of role, see whether a job change means redoing the 9G and AEP.
Items with a substitute: exclusion or exemption certificates and renewal affidavits
'No AEP' does not always mean 'document missing'. BI's checklist accepts the AEP or a Certificate of Exclusion or Exemption with a validity period. Directors and staff seconded from abroad may not need an AEP, but you first apply to DOLE and obtain the certificate, and that certificate is the substitute you hand to BI. Extensions differ too. The first-time conversion checklist is BI Form V-NI-007; the extension checklist is V-NI-008.
- First-time conversion: the AEP is new, with newspaper publication, a sworn statement and the labour market test.
- Extension: no AEP publication line. On AEP renewal the publication and training plan can be replaced by an affidavit of undertaking, and the expiring AEP card must be surrendered, with an affidavit of loss and police report if lost.
In the other direction, an expired AEP can no longer be handled as a renewal. The renewal window is up to 60 calendar days before expiry, and after that the process practically restarts; see whether a 9G stays valid after the AEP expires.
Counter-dependent items: follow the current requirement
For these items the website checklist, the citizen's charter and counter practice do not always agree, so confirm on the spot:
- Situational papers: regulated professions need a special temporary permit from the Professional Regulation Commission (PRC); nationalised or partly nationalised industries need the Department of Justice authorisation to employ foreigners; certain nationalities who entered after June 2014 need a quarantine medical certificate. The BI Clearance Certificate and the medical certificate are worded differently in the 2026 charter than on the web checklist, so follow what the counter requires at the time.
- Passport and authorised stay: at least 30 days of valid authorised stay when fees are assessed; if short, extend the visitor status first.
- Application form: the CGAF in English capitals, N/A where a box does not apply, never blank; two originals (one with the file, one for the ACR I-Card application), signed in ink by the applicant and the employer's representative.
- Foreign documents: originals authenticated by the Philippine embassy or consulate, with an English translation if needed; the charter's dependant entry adds that an Apostille is also accepted.
One easy omission: BI's checklist has no line for degree certificates, but the AEP at DOLE requires them, so do not skip them because BI's list is silent. At filing, the original passport goes to the Central Receiving Unit (CRU) for scanning and is returned, and you need the original again at any evaluation or interview.
Who can file, and when to hold off
'Who can file' has two layers. First, who submits: the employer is petitioner and the employee the beneficiary, and control of both the AEP and the 9G sits with the company, so an individual employee cannot do it alone. The employee prepares the passport, signatures, qualification papers and family relationship proof, and each family member who applies alongside needs a separate set of documents. Second, when to hold off:
- No AEP card yet, or it has expired: wait in the first case; in the second the process restarts. An expired AEP does not void the 9G by itself, but the work permit is gone and you may not keep working.
- Short stay, non-current company papers, no proof of tax payment: complete them first. If the company is still being set up or its compliance file is chronically incomplete, fix that first; see company setup support.
- New employer: both permits are tied to the employer with no transfer; the new company files as a first-time conversion.
- Role changed in substance: the AEP is tied to person, position and employer together, so a real change of duties generally means a new application.
The downside for readers: few steps can be skipped, many trips can be wasted
- No file-first-top-up-later shortcut. Missing items are returned on the spot, and whether an AEP receipt is accepted varies by counter.
- No fixed timeline. BI's 2026 charter grades the commercial 9G as Highly Technical, its highest tier, so do not expect a same-day result. We give no fixed number of days; see how long each 9G stage takes.
- Foreign documents take longest. Translation, authentication and notarisation cost the most time, so start them first.
- An expired AEP is costly. Once the renewal window has closed, the AEP goes back to new publication, a new labour market test and the full fees. Do not plan to fix it at the next 9G extension: DOLE and BI now share AEP data, and BI uses it to verify 9G conversions and extensions, so that is exactly when a lapse gets checked.
- A branch that can accept is not one that can finish. Some offices only receive and pre-check; ask before travelling, see where to apply for a 9G.
