Your PWP Has Expired and the 9G Is Still Pending: Can You Keep Working?

Updated 2026-10-14·9 min read·Visa & HR

The careful course first: when a Provisional Work Permit runs out and the 9G has not been approved, do not assume that 'the application is still pending, so I can keep working'. A PWP is an interim permit with a fixed term. Whether you may work in the gap after it ends depends on the Bureau of Immigration's current practice and on whether you hold a permit that is still valid. An employer saying 'it is fine' does not settle it. The sequence least likely to go wrong is to stop reporting for work on the expiry date, have the employer ask the receiving office in writing, and find out where the 9G is stuck.

The framework: a PWP does not roll into a 9G, so do not assume

The short answer: expiry of the PWP and approval of the 9G are two separate events with no automatic bridge between them. Do not decide for yourself whether work may continue in the gap. Follow the current written position of the Immigration office handling the file.

Keep three things apart. The PWP is an interim work permit issued by the Bureau of Immigration so that someone who has already filed for an employment visa can work lawfully while waiting. It has a defined validity and a cumulative limit. The 9G is the employment visa itself and gives long-term work status only once approved and implemented. Your status of stay in the passport remains temporary visitor until that implementation, and it is kept alive by extensions. What a PWP is and how official sources describe its term and renewal are covered in the Provisional Work Permit explained, so the figures are not repeated here.

Two elements decide whether work is possible in the gap. The first is whether you hold, at this moment, a work permit document that is within its validity. The second is how the receiving office currently treats the situation of an expired interim permit with the main application still pending, including whether it accepts a further application or another interim arrangement. You can check the first yourself. The second you can only ask about, and the answer should be in writing.

Two claims that circulate online should not be taken at face value. One says that a pending application equals permission to work. The other says that a single day past expiry is illegal work followed by immediate deportation. The first has no basis, and the second overstates how certain the outcome is. What happens depends on the facts of the case and the agency's finding.

On the expiry date, or within 24 hours of noticing: three steps each

The principle for the first day is to stop, then ask, and keep a record throughout.

  • Employee, one: check the expiry on the PWP document and the expiry of the visitor stay in your passport. Write both down.
  • Employee, two: tell HR in writing that your interim permit expired on a given date and that you will not report for work until the company gives a written arrangement. Keep proof of sending.
  • Employee, three: gather the papers you hold: the PWP original, the 9G receiving copy, the DOLE permit card and your latest extension receipt.
  • Employer, one: stop scheduling the employee and stop having that person act for the company externally, and confirm the start date of the pause in writing.
  • Employer, two: have the handler ask the office processing the 9G, in writing, for the current status of the application and for the arrangement available after the interim permit expires, with the documents required.
  • Employer, three: check the PWP expiry dates of other foreign staff so the same problem does not appear again next week.

Stopping is uncomfortable for an employer with a project under way and a person who already knows the role. But the cost of pausing for some days can be calculated, and the cost of a finding of unauthorized employment cannot. If work has already continued for a few days after expiry, do not backdate documents or reconstruct records to hide it. Keep the attendance record as it is and move quickly to the written inquiry. The consequences and remedies when a short-term permit lapses while the holder is still at work are analysed in what happens when an SWP expires and you are still working, and the reasoning is similar.

Why the gap appears: four causes and whom to chase for each

A gap rarely exists simply because approval 'is slow'. There is usually a specific sticking point, and you need to find it to know whom to chase.

Cause one: the DOLE step is unfinished. Without the employment permit, the main application at Immigration cannot advance. The person to chase is whoever at the company handles the DOLE filing.

Cause two: the main application was returned or a deficiency was noted, and the company did not respond in time. Employees often know nothing about this and hear only that it is 'being processed'. Ask the company for a copy of the receiving document and the latest correspondence and read the status yourself. How to tell the reasons for a return apart is explained in what to do when 9G documents are returned.

Cause three: the main application was filed late. After the PWP was issued, the company delayed submitting the 9G petition and remembered only when the PWP was about to end. Here the person to chase is the company's decision-maker, not the counter. A step-by-step way to press a slow employer is in what to do when the company delays your 9G.

Cause four: the application is genuinely in the normal queue. How the stages are ordered and where delays tend to occur are described in the 9G processing timeline. Even then, the conclusion above stands: the right to work during the queue comes from a valid permit, not from being in the queue.

Identifying the cause has a second benefit. When the employer writes to the receiving office, the facts can be stated precisely, and a precise question is far more likely to receive a specific and usable answer.

Lawful arrangements for the gap, each depending on a written reply

No single arrangement fits every case. Each of the following depends on the written reply of the receiving office, and which one is available depends on the facts.

Arrangement one: pause and wait for approval. This holds up in every situation. The company and the employee agree in writing on treatment during the pause and an expected date of return, and the employee uses the time to complete personal documents.

Arrangement two: follow whatever interim procedure the office confirms it accepts. Whether an interim permit can be applied for again, whether the cumulative limit has been used up and which papers are needed all depend on the Bureau's current practice. If the reply is positive, work resumes only after the new permit is actually issued, not when it has merely been filed.

Arrangement three: concentrate on the sticking point in the main application. Many gaps are one missing document or one personal appearance away from closing, and fixing that is more effective than any interim measure.

Arrangement four: change course if approval is not realistic in the near term. If the company decides not to continue the hiring, it withdraws the application properly and arranges the employee's status. The employee's side of a withdrawal is described in a companion guide, withdrawing a pending application and recovering your passport.

Two practices are not lawful arrangements. One is relabelling the employee as a consultant, trainee or visitor while the actual work continues. The label changes but the facts do not, and findings are based on facts. The other is having the employee work on visitor status now and 'regularize after approval'. The exposure this creates for the company across several agencies is described in the consequences of hiring a foreigner without a work permit.

Risks on both sides, and the visitor stay that everyone forgets

The risk in the gap runs in two directions. The employee carries the status consequences and the employer carries the employment consequences, and both can affect the 9G that is still pending.

For the employee, a finding of work without authorization may bring fines and may affect the pending application, and in serious cases may involve cancellation of status and a requirement to leave. The actual outcome is determined by the authorities case by case, and this guide does not predict it. For the employer, apart from what happens with that one employee, the applications of other foreign staff and the company's future standing as a petitioner may be affected.

One track is forgotten more than any other. Until the 9G is implemented, your lawful presence rests on the visitor stay. An expiring PWP makes people look at the work permit and not at the stay, so the work issue is still open when an overstay is added to it. The difference between the expiry date and the following day is explained in whether an extension has a grace period. If the expiry date falls on a holiday or weekend, see the companion guide when a visa expires on a holiday.

Avoid leaving the country during the gap. Departure while the main application is pending is treated in most cases as abandoning it, and the process starts again on return. If you have already left, read you left while your visa was pending.

An employee can reasonably ask the company to put the pause in writing. It protects you from being marked absent without leave, and it lets the company show later that nobody without a permit was kept at work.

Three things not to do, and where Yixing can help

Three things to avoid: backdating or fabricating a permit document, believing that a small payment will get 'a stamp to cover the gap', and treating someone else's experience as your authority when you have no written reply of your own.

The first two turn a gap that could be explained into a question about the authenticity of documents, which is a different order of problem. If someone offers that kind of solution, read how to respond to fixers and bribe requests at Immigration. The third looks harmless and is the most common. Offices, periods and visa types are not handled identically, and a colleague's experience last year proves nothing for you.

What Yixing can do: verify the true status of the 9G and its sticking point, so that 'in process' becomes a specific statement; draft and file the written inquiry to the receiving office and prepare the interim procedure it confirms; and place the PWP, the visitor stay and the DOLE permit on one schedule with advance reminders. What we cannot do is tell you that you may start working, or promise the outcome of an interim permit or a 9G. The answer to this question depends on the Bureau's current practice, and it should be verified by an accredited firm or a licensed lawyer before anyone acts. Begin with our visa and HR service and bring the PWP original, the 9G receiving copy and your passport.

Frequently Asked Questions

My PWP expired and the 9G is not approved. Can I keep working?
Do not assume so. It depends on the Bureau of Immigration's current practice and on holding a valid permit. The careful course is to stop reporting for work and have the employer ask the receiving office in writing.
Can a PWP be renewed or applied for again after it expires?
A PWP has a fixed validity and a cumulative limit. Whether another is possible depends on the time already used and current practice, so rely on the office's written reply.
The company says a pending 9G is enough and wants me at work. What should I do?
Ask the company to put that instruction and its basis in writing. Without a valid permit or a written reply from the agency, tell the company in writing that you will not report yet.
I already worked a few days after the PWP expired. What happens?
The consequences are decided case by case. Do not backdate anything. Keep accurate records, stop reporting now and have the employer ask in writing how to remedy it.
What is my immigration status during the gap?
Until the 9G is implemented your status of stay is temporary visitor, maintained through extensions. Check that expiry date whenever you check the PWP.
Can I go home and wait for approval abroad?
Leaving while the main application is pending is in most cases treated as abandoning it. Ask the handler in writing what departure would mean before you go.
The 9G never seems to move. How do I find out why?
Ask the company for the receiving copy and recent correspondence. Common causes are a pending DOLE permit, an unanswered deficiency notice or a late filing, and each has a different person to chase.
